MoonBrief End User License Agreement

Apple Standard EULA

MoonBrief is distributed through Apple's App Store and is licensed, not sold. Unless Sublimate LLC provides a separate custom license in App Store Connect, MoonBrief is subject to Apple's Standard End User License Agreement. This page adds MoonBrief-specific terms that apply in addition to Apple's Standard EULA. If these terms conflict with Apple's required terms, Apple's required terms control to the extent required by Apple or applicable law.

License

Sublimate LLC grants you a limited, non-exclusive, non-transferable revocable license to use MoonBrief on Apple-branded devices that you own or control as permitted by Apple's rules and this agreement.

Acceptable Use

You agree that you will not:

• copy, modify, distribute, sell, lease or sublicense MoonBrief;
• reverse engineer, decompile or attempt to extract MoonBrief source code except where applicable law allows it;
• use MoonBrief in a way that violates law, regulation, aviation rules, third-party rights or Apple's terms;
• interfere with MoonBrief, its ads, purchases, security features or related third-party services;
• use MoonBrief to submit harmful, misleading or unlawful feedback or communications.

Aviation And Weather Information

MoonBrief may display or calculate aviation, airport, sun, moon, weather and route-related information. MoonBrief is provided for planning, convenience and general informational purposes only. It is not a certified aviation navigation, flight planning, weather, dispatch, safety or operational decision-making system.

You are solely responsible for verifying all information using official sources, complying with all applicable aviation regulations and procedures and exercising independent pilot, crew, dispatcher or operational judgment. Do not rely on MoonBrief as the sole source for any flight, mission, weather, safety or operational decision.

Third-Party Services

MoonBrief may use third-party services, including Apple services, Google AdMob, Google User Messaging Platform, Aviation Weather Center / aviationweather.gov and the iOS Mail app. Third-party services may be unavailable, delayed, inaccurate, changed or discontinued. Your use of third-party services may be subject to their own terms and privacy policies.

Ads And In-App Purchases

MoonBrief is planned to be free with ads. Optional ad-free access may be available through Apple in-app purchases, including monthly, annual and lifetime options. Purchases and subscriptions are handled by Apple and are subject to Apple's payment, renewal, cancellation and refund rules.

Ownership

MoonBrief, including its design, software, text, graphics, logos and related materials, is owned by Sublimate LLC or its licensors and is protected by intellectual property laws. No ownership rights are transferred to you under this agreement.

No Warranty

MoonBrief is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by applicable law. Sublimate LLC does not warrant that MoonBrief will be uninterrupted, error-free, accurate, complete, current, secure or suitable for any particular purpose.

Limitation Of Liability

To the maximum extent permitted by applicable law, Sublimate LLC will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages or for lost profits, lost data, business interruption, aviation-related losses, operational losses or damages arising from reliance on MoonBrief or third-party services.

Termination

This license remains in effect until terminated. Your rights under this agreement will terminate automatically if you violate this agreement. Upon termination, you must stop using MoonBrief and delete it from your devices.

Changes

Sublimate LLC may update this agreement as MoonBrief changes. The effective date above will be updated when this agreement changes. Continued use of MoonBrief after an update means you accept the updated agreement.
